6) Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied,
including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant
uninterrupted or error‑free operation.
7) Limitation of Liability
To the maximum extent permitted by law, Tamarack Ranch will not be liable for any indirect, incidental,
special, consequential, or exemplary damages, or for loss of profits, revenues, data, goodwill, or business
opportunities arising from or related to your use of the Services, even if advised of the possibility of such
damages. Our aggregate liability will not exceed the amount you paid to us for the Services giving rise to
the claim in the 12 months preceding the event.
8) Indemnification
You agree to defend, indemnify, and hold harmless Tamarack Ranch and its affiliates, officers, employees,
and agents from and against claims, damages, liabilities, costs, and expenses arising from your use of the
Services or violation of these Terms.
9) Termination
We may suspend or terminate access to the Services at any time, with or without notice, for any reason.
Upon termination, your right to use the Services will cease.
10) Governing Law; Disputes
These Terms are governed by the laws of the State of [Montana] and applicable U.S. federal law, without

Violations of others’ privacy or intellectual property rights;
Misrepresenting affiliation with Tamarack Ranch.
2) Email & Messaging
Use only permission‑based lists and provide clear opt‑out mechanisms. Do not use purchased or scraped
lists. Maintain records of consent where required.
3) Security & Customer Responsibility
You are responsible for implementing reasonable security measures and for actions taken using your
accounts or integrations connected to our Services.
4) Enforcement
We may investigate suspected violations and take action, including removing content, suspending access,
or reporting to authorities where required.
5) Modifications
We may update this AUP periodically. The revised version becomes effective when posted.
